This sets out how we manage your personal information to ensure security, transparency, and compliance with data protection standards.

  1. Introduction

    1. This privacy notice sets out the basis on which any Personal Information (as defined in clause 2 below) that Future Forex SA (Pty) Ltd (FF) collects relating to you, will be used, stored and otherwise processed by or on behalf of FF.
    2. FF is a private company incorporated under the laws of the Republic of South Africa, with its primary place of business at 66 Roeland St, Gardens, Cape Town, Western Cape, 8001.
    3. FF is a “Responsible Party” in respect of the Personal Information described in this privacy notice. This means that we are responsible for deciding how we hold and use Personal Information about you. We are required under data protection legislation to notify you of the information contained in this privacy notice.
    4. It is important that you read this privacy notice carefully before submitting any Personal Information to FF, using our Website, or our Services.
  2. Definitions

    1. For purposes of this privacy notice:
      1. Applicable Laws means all laws and regulations that FF is required to comply with;
      2. eFilling means an online service provided by the South African Revenue Service (SARS) that allows taxpayers to manage their tax affairs securely;
      3. Personal Information means information relating to an identifiable, living, natural person, and (where applicable) an identifiable, existing juristic person, including the name, race, gender, marital status, address and identifying number of a person, symbol, e-mail address, physical address, telephone number, location information, online identifier or other particular assignment to the person;
      4. POPIA means the Protection of Personal Information, 2013 and any regulations or applicable codes of conduct promulgated thereunder;
      5. Process means any activity that involves the use of Personal Information. It includes any operation or activity or any set of operations, whether or not by automatic means, concerning Personal Information, including:
        1. the collection, receipt, recording, organisation, collation, storage, updating or modification, retrieval, alteration, consultation or use;
        2. dissemination by means of transmission, distribution or making available in any other form; or
        3. merging, linking, as well as restriction, degradation, erasure or destruction of information;
      6. Services means the services that FF provides by trading cryptocurrency as your agent for and on your behalf;
      7. Special Personal Information means Personal Information concerning the religious or philosophical beliefs, race or ethnic origin, trade union membership, political persuasion, health or sex life or biometric information of a data subject; or the criminal behavior of a data subject to the extent that such information relates to the alleged commission by a data subject of any offence. It also covers information about a Data Subject’s criminal behavior if it relates to alleged crimes they might have committed, or any legal proceedings related to those alleged crimes;
      8. Website means the FF website with the web address futureforex.co.za; and
      9. you or your refers to any third party of FF, for example our customers, suppliers, contracting parties, business partners, website users, etc.
  3. Information FF may collect about you

    1. FF may collect and process the following information (which may include Personal Information, including sensitive or special personal information) about you when you interact with FF on our Website or when you use our Services:
      1. Information that you provide by filling in forms or any other activity when using the Service or the Website. This includes information provided at the time of registering to use the Service or the Website, such as your name, identification details (including ID number and date of birth), contact details, employment information, financial and tax-related details, and sensitive or special Personal Information (such as biometric data including images, fingerprints, and voiceprints), where required by law or regulatory obligations or where explicit consent has been provided by you.
      2. Details of transactions you carry out through the Service or Website including information necessary for the fulfilment of any contract you enter into with FF. This includes, your, bank account details (for instance, to process withdrawals), information regarding the purpose and recipient of payments (for instance, when processing forex transactions) and proof of source of funds (for instance, arbitrage transactions) and any other necessary information to comply with regulatory obligations, including anti-money laundering (AML) requirements
      3. Details of your use of and visits to the Website.
      4. Details in any correspondence you exchange with us.
      5. Details in any postings or on any blogs, forums, platforms, wikis or social media applications and services that we provide (including with third parties)
      6. Information uploaded to the eFiling platform.
    2. When you visit the Website, FF may collect certain information that is not Personal Information such as your operating system, browser type, and Internet service provider. This type of information does not identify you personally.
    3. Personal Information may be collected directly from you, or indirectly from third-party sources such as analytics providers, marketing platforms, public sources, social media platforms and the eFiling platform.
    4. Where you provide us with the Personal Information of third parties:
      1. you should take steps to inform the third party that you need to disclose their details to us, identifying FF; and
      2. you warrant that you are authorised to provide us with such Personal Information and that you have complied with Applicable Law (for example, obtaining consents, directing them to our Privacy Notice, etc.) in doing so.
    5. By using the Service and the Website, you consent to collection, storage, and use of the Personal Information you provide in relation to any features of the Service and the Website, or which we collect elsewhere, including from the eFiling platform, and you consent to FF’s collection of any changes or updates that you may provide to any information you provide that is collected by FF.
    6. Providing your Personal Information is generally voluntary. However, certain data may be mandatory for regulatory compliance or service provision. Failure to provide required data may limit FF's ability to offer services or fulfil contractual obligations we have with you

  6. Storage and security of your Personal Information

    1. FF will do its best to protect your Personal Information, and FF will use technology that will help FF to do this. However, the transmission of information via the Internet is not completely secure and FF cannot guarantee the security of your information transmitted to FF. Any transmission of your information to FF is entirely at your own risk. Once FF has received your information, FF will use strict procedures and security features to try to prevent unauthorised access
    2. We will retain your Personal Information for as long as it is necessary to achieve the purpose for which it was collected, and in some cases this may be for an indefinite period, if we are permitted or required to do so in terms of Applicable Laws. However, as a general rule, we will retain your Personal Information in accordance with retention periods set out in Applicable Laws, unless we need to retain it for longer for a lawful purpose (for example, for the purposes of complaints handling, legal processes and proceedings).
  7. Cookies and device information

    1. FF may collect information about your electronic devices, including your mobile phone, tablet, computer, including where available your operating system and browser type, for system administration. This is statistical data about FF’s users’ browsing actions and patterns, and does not identify any particular person.
    2. FF may use cookies to manage FF’s users’ sessions and to store preferences, tracking information, and language selection. Cookies are small text files transferred by a web server and stored on your electronic device. The types of information a Cookie collects include, among other things, the date and time you used the App, your browsing history, your preferences, and your username.
    3. FF cannot control or access Cookies used by third party service providers. This Privacy Policy covers only Cookies used by FF, and not any Cookies used by third parties.
    4. Cookies enable FF to –
      1. estimate FF’s user audience size and usage pattern;
      2. store information about your preferences, which allows FF to customize the Service and Website according to your individual interests;
      3. speed up your searches; and
      4. recognise you when you return to the Website.
    5. You have the ability to either accept or decline the use of Cookies on your electronic device. Typically, you can configure your electronic device to not accept Cookies. However, declining the use of Cookies may limit your access to certain features of the Service and the Website.
  8. Third parties

    1. The Website may occasionally contain links to third parties’ websites. FF is not responsible for the content of those website or for the security of your Personal Information when you use the Third-Party websites.
    2. This privacy notice does not govern Personal Information provided to, stored on, or used by these third-party providers and Third-Party websites. FF recommends that when you enter a Third-Party website, you review the Third-Party website’s privacy policy as it relates to how such third parties collect, process, store and protect your Personal Information.
  9. How your information is used and disclosed

    1. FF may use the information, including the Personal Information FF holds about you or collects from third parties –
      1. to ensure that content from the Website is presented in the most effective manner for you and for your electronic devices;
      2. in aggregated form, for internal business purposes such as generating statistics and developing FF’s strategic and marketing plans;
      3. to allow you to participate in interactive features on the Website, when you choose to do so;
      4. to administer, maintain and ensure the security of our information systems, applications and websites;
      5. to render the Service;
      6. to respond to your queries;
      7. to notify you about changes to the Website;
      8. to enforce the Terms, monitor user activity and more effectively manage traffic on FF’s website;
      9. to provide customer services, and create and manage user accounts; and
      10. to assist you with technical difficulties
    2. FF may also share with third-parties certain information which FF has collected for purposes necessary to deliver the Service to you, comply with legal and regulatory requirements (such as Know-Your-Customer obligations), or facilitate essential transactional processes.

      Additionally, FF may share limited information with third-party analytics providers to better understand your preferences and improve the features of the Service and the Website.

    3. We may from time to time contact you about services, products and offerings available from FF which we believe may be of interest to you, by email, phone, text or other electronic means, unless you have unsubscribed from receiving such communications. You can unsubscribe from receiving such communications by contacting us, or following the prompt in any communications we send you.
    4. Your Personal Information may be shared with our affiliates, subsidiaries, our agents and sub-contractors, and selected third parties who Process the information on our behalf.
    5. We may also disclose your Personal Information to third parties for the purposes listed in paragraph 8.1 above
    6. If you do not wish us to disclose this Personal Information to third parties, please contact us. We may, however, not be able to provide products or services to you if such disclosure is necessary.
  10. Your rights

    1. You have the right to:
      1. request access to the Personal Information FF holds about you. For more information about how to exercise this right, you can view FF’s PAIA Manual by clicking here;
      2. request correction of the Personal Information you provided to FF by email. Please ensure that the information we hold about you is complete, accurate and up to date;
      3. object on reasonable grounds to the Processing of your Personal Information where the Processing is carried out in order to protect our or a third party’s legitimate interests or your legitimate interests, unless the law provides for such Processing;
      4. withdraw your consent to the processing of your Personal Information at any time, where processing is based on your consent;
      5. in certain circumstances to request the destruction or deletion of and, where applicable, to obtain restriction on the Processing of Personal Information held about you. If you wish to exercise this right, please contact us; and
      6. lodge a complaint with the Information Regulator if you believe your Personal Information has been unlawfully processed.
    2. FF may also send you any legally required notifications and certain notifications, including Service related notices or notices regarding a change to any of FF’s Terms or policies.
    3. FF will not change your preferences without your consent. Please however note that you will not be able to opt out of receiving transactional communications from FF related to your account.
  11. Cross Border Transfers

  12. Your Personal Information may be transferred to and stored in countries outside South Africa, where FF's third-party service providers are located. FF ensures such transfers comply with Applicable Law and that appropriate data protection safeguards are in place.

  14. FF reserves the right to change this privacy notice from time to time, and in its sole discretion. FF may send you a notice regarding material changes to this privacy notice.

  15. Complaints

    1. Should you believe that FF has utilised your Personal Information contrary to Applicable Laws, we would appreciate if you could first attempt to resolve any concerns with us.
    2. If you are not satisfied with such processes, you may have the right to lodge a complain with the Information Regulator, using the contact details listed on their website: https://inforegulator.org.za/contact-us/.
